Why we ask for working days: the private-sector labour law states that employee dues including daily wage and leave are calculated using salary divided by the number of actual working days, excluding weekly rest days. MalluKuwait therefore does not silently assume that every worker uses the same 26-day or 30-day divisor.

Article 70 โ€” Annual Leave

The amended Article 70 provides private-sector workers with paid annual leave of at least 30 working days.

For the first year, the amended rule provides eligibility after completing at least six months in the employer's service.

Leave for a fraction of a year is proportional to the period spent in work, including during the first year.

Weekly rest days, official holidays and sick-leave days falling within annual leave are not counted as annual-leave days under the amended wording.

Why some English copies still say 9 months

An English PDF of Law No. 6 of 2010 currently available through PAM still displays the older Article 70 wording referring to nine months. Article 70 was subsequently amended. Kuwait Government Online publishes the amended wording with a six-month first-year threshold. MalluKuwait therefore uses the amended six-month rule for this calculator.

Articles 71โ€“74

Article 71 addresses payment of annual-leave salary before the worker takes the leave.

Article 72 addresses scheduling and accumulation of annual leave, subject to its conditions.

Article 73 provides for a cash equivalent for accumulated annual-leave days upon expiry of the employment contract, subject to the law.

Article 74 contains restrictions relating to assigning or waiving annual leave.
