Kuwait Annual Leave Guide
If you work in Kuwait's private sector, annual leave is more than simply counting 30 calendar days. The law deals with working days, first-year eligibility, official holidays and weekly rest days falling during leave, leave salary, accumulated leave and what happens to unused leave when employment ends.
This guide explains the main rules under Kuwait's private-sector Labour Law No. 6 of 2010 and its amendments.

How many annual leave days do private-sector workers get?
The amended Article 70 provides a worker with paid annual leave of at least 30 working days.
The words "at least" are important. A contract or employment arrangement may provide a more favourable entitlement.
This guide is for private-sector employment governed by Kuwait Labour Law No. 6 of 2010 and its amendments. Government employment and domestic-worker employment operate under different legal frameworks and are outside the scope of this guide.
What is the 6-month rule for the first year?
Under the amended Article 70, a worker becomes entitled to annual leave for the first year after completing at least six months in the employer's service.
This is different from some older English copies of the labour law that still show a nine-month threshold.
The amended wording published through Kuwait Government Online uses six months.
Do not rely only on an old PDF or an old article that says nine months. Check the amended law and current official guidance when the distinction matters.
Does annual leave accrue during part of a year?
Article 70 also provides proportional leave for fractions of a year according to the period spent in work, including during the first year.
For a simple estimate, someone with a 30-working-day annual entitlement effectively accrues leave proportionally over their service period.
MalluKuwait's calculator uses exact employment dates to provide a transparent proportional estimate rather than assuming that every partial month should be rounded in the same way.
Do weekly rest days count as annual leave?
Under the amended Article 70 wording, weekly rest days occurring during annual leave are not counted as annual-leave days.
This is one reason that "30 working days" should not automatically be treated as simply 30 consecutive calendar days.
What about official holidays during annual leave?
Official holidays falling during annual leave are not counted as annual-leave days under the amended Article 70 wording.
The exact dates and applicable official holidays can vary by year, so employees should check the relevant current holiday announcements and their employer's records.
What if I become sick during annual leave?
The amended Article 70 also excludes sick-leave days occurring during annual leave from the annual-leave count, subject to the applicable sick-leave rules and proper documentation.
Keep medical certificates and other relevant records where required.
When should annual-leave salary be paid?
Article 71 states that the worker is entitled to receive the salary due for annual leave in advance before taking the leave.
If there is a disagreement over the amount or wage components used, check your employment contract, payroll records and the current applicable law.
Can the employer decide when annual leave is taken?
Article 72 gives the employer a role in determining the annual-leave date.
The same Article contains rules concerning partial leave and accumulation of annual leave.
Because leave scheduling can involve both statutory rules and workplace arrangements, employees should keep approved leave requests and employer confirmations in writing where possible.
Can annual leave be accumulated?
Article 72 provides for accumulation of annual leave subject to its conditions.
The law text provides for accumulation up to the leave of two years and also addresses taking accumulated leave and accumulation for longer periods by mutual agreement.
Do not assume that an unlimited number of years can automatically be carried forward without considering Article 72, your records and any applicable agreement.
What happens to unused annual leave when employment ends?
Article 73 provides that, subject to Articles 70 and 71, the worker has the right to receive a cash equivalent for accumulated annual-leave days upon expiry of the employment contract.
This can become particularly important when calculating a final employment settlement.
Article 73 concerns the cash equivalent of accumulated annual leave upon expiry of the contract. It should not be interpreted as a general right to demand cash for unused leave at any time while employment continues.
How can I estimate the value of unused leave?
The labour-law text contains a wage-calculation rule stating that employee dues including daily wage and leave are calculated by dividing salary by the number of actual working days without counting weekly rest days.
Because working schedules can differ, MalluKuwait does not silently assume that every worker has the same 26-day or 30-day divisor.
Our calculator therefore asks you to enter:

It then shows the estimated daily leave rate and estimated positive unused-leave cash value.
Example:
Monthly wage: KD 520 Actual working days: 26 Estimated daily leave rate: KD 20
If the estimated positive unused-leave balance is 20 working days:
20 Ã KD 20 = KD 400 estimated cash equivalent.
This is an illustration only. Actual final settlement calculations can depend on the legally applicable wage, wage components, records, contract and individual circumstances.
Why does MalluKuwait say 6 months when a PAM English PDF says 9 months?
This is an important source-version issue.
An English copy of Law No. 6 of 2010 currently available through the Public Authority for Manpower still displays the older Article 70 wording stating that first-year leave becomes available after at least nine months.
Article 70 was subsequently amended.
Kuwait Government Online publishes the amended Article 70 wording stating that first-year annual leave is available after at least six months of service and that the entitlement is at least 30 working days.
For this reason, MalluKuwait uses the amended six-month rule while also warning readers that older English copies may still show the pre-amendment wording.
Can an employee sell or waive annual leave?
Article 74 restricts assignment of annual leave, whether with or without compensation, subject to Article 72.
Article 74 also addresses recovery of leave salary where it is proven that a worker worked for another employer during the leave.
This is another reason not to treat annual leave simply as money that can automatically be exchanged whenever the worker chooses.
What records should you keep?
Keep copies of:
Employment contract âĸ Work permit and relevant employment documents âĸ Salary records and payslips âĸ Approved annual-leave requests âĸ Leave-balance records âĸ Sick-leave documentation where relevant âĸ Employer correspondence about leave âĸ Final settlement documents when employment ends
Records can be especially important if the employee's leave balance differs from the employer's calculation.
Annual leave and end-of-service settlement
Unused annual leave and end-of-service indemnity are separate calculations, although both may become relevant when employment ends.

Annual leave and overtime are different rights
Annual leave should not be confused with overtime compensation.
Overtime, weekly rest-day work and official-holiday work are dealt with under separate provisions of the labour law.
